Trump team asks top Georgia court to deny Fani Willis disqualification appeal
President-elect Trump’s legal team submitted a written opposition Friday to the Georgia Supreme Court over Fulton County District Attorney Fani Willis’s request to have the state's high court review her removal from the former president’s 2020 election interference case.
Trump’s lawyers argue a review from the high court is not a right and should only be granted “in cases of great concern, gravity, or importance to the public,” according to court filings.
They cited the majority opinion from the state’s court of appeals on Willis, which said the appearance of impropriety was “significant” and an “odor of mendacity” stands.
In a Wednesday petition, Willis argued that the lower court “overreached” in their ruling.
She was disqualified from the case after it was revealed that she had a relationship with special prosecutor Nathan Wade, whom she hired on to the case.
“No Georgia court has ever disqualified a district attorney for the mere appearance of impropriety without the existence of an actual conflict of interest,” her team declared.
“And no Georgia court has ever reversed a trial court’s order declining to disqualify a prosecutor based solely on an appearance of impropriety.”
The appeals court ruling reversed Fulton County Superior Court Judge Scott McAfee’s decision to allow the district attorney to stay on the case if Wade stepped aside, which he did.
