Texas AG adds gender screening request to NCAA lawsuit
Texas Attorney General Ken Paxton asked a judge on Thursday to require the NCAA to start gender testing for athletes who compete in women’s sports.
The request for a temporary injunction adds a filing to his December 2024 lawsuit against the NCAA, which argues the group “falsely and deceptively" claims that "only biological women may participate in female-specific competitions."
The college athletics organization barred transgender athletes from participating in women’s sports in February following President Trump’s executive order outlawing biological males from such competitions. The order included the 2028 Olympics in Los Angeles.
However, Paxton said there are no regulations on gender screening to ensure athletes are not involved in integrated play.
“Far from aligning with President Trump’s executive order or basic reality, the NCAA’s new policy treats sex as a changeable characteristic determined by a birth certificate instead of biology,” Paxton said in a Thursday statement.
“I am asking the court to enjoin the NCAA from continuing these deceptive schemes and protect women’s sports.”
Oral swabs are typically used to determine a person’s sex assigned at birth. It’s unclear how the NCAA would plan to implement gender screening if Paxton’s request is upheld by a judge.
The organization's president said there are fewer than 10 transgender college athletes.
