See where abortion will be on the ballot in the 2024 election
(NEXSTAR) -- Voters in some states will soon decide on crucial abortion-related measures, marking another pivotal moment in the ongoing national debate over reproductive rights.
This follows the Supreme Court's decision in 2022 to overturn Roe v. Wade, giving individual states the power to regulate abortion and ending nearly 50 years of federal protections.
Since the landmark ruling, several states have enacted bans or restrictions, while others have moved to enshrine abortion access. The November 2024 election will reflect this divide, with ballot measures highlighting the different ways states are handling abortion in the post-Roe era.
Efforts to protect or restrict abortion access will be considered in a record 10 states: Arizona, Colorado, Florida, Maryland, Missouri, Montana, Nebraska, Nevada, New York, and South Dakota.
Here's a look at the specific measures voters will weigh:
Arizona
A proposition would allow voters to amend the state constitution to protect abortion access up to 24 weeks of pregnancy. It would also let healthcare providers decide when a fetus can survive outside the womb, known as fetal viability. Currently, state law restricts abortion after 15 weeks.
Colorado
An amendment would secure abortion rights in the state constitution and require Medicaid and private insurers to cover abortion services. Colorado already permits abortion at any stage of pregnancy, but this measure aims to protect those rights from future legislative changes.
Florida
A proposed amendment to the state constitution would protect the right to an abortion until fetal viability, or later, to protect the health of the pregnant person. The measure needs 60% of voters’ support to pass, challenging the state’s current six-week abortion ban.
Maryland
Voters will decide whether to enshrine the right to reproductive freedom, including abortion, in the state constitution. Abortion is already legal until viability, but the measure would further protect against future restrictions.
Missouri
Missouri’s ballot measure would create a right to abortion up to fetal viability and protect reproductive decisions related to miscarriage and prenatal care. The amendment would reverse the state’s near-total ban on abortion if passed.
Montana
A ballot measure in Montana seeks to protect the right to abortion in the state constitution, preventing government interference before fetal viability. Abortion is currently legal in Montana under a 1999 state Supreme Court ruling, which this measure would reinforce.
Nebraska
Voters will decide between two competing amendments: one that would allow abortion up to fetal viability, and another that would enshrine the current 12-week ban in the state constitution, with exceptions for rape, incest, and to protect the life of the pregnant person.
Nevada
Nevada’s initiative proposes adding abortion rights to the state constitution, allowing the procedure up to 24 weeks of pregnancy. If passed, the amendment would need voter approval again in 2026 to be fully enacted.
New York
A proposal in New York would broaden anti-discrimination protections to include reproductive healthcare and pregnancy outcomes. Though it does not explicitly mention abortion, it is expected to safeguard access through broader equal rights language.
South Dakota
A citizen-led initiative in South Dakota would guarantee the right to abortion in the first trimester and restrict it in later stages, except when necessary to protect the life or health of the pregnant person. Currently, the state has a near-total ban on abortion.
